Does anyone know whether you can make statutory adjustment and subtract outstanding tax owed to SARS from an employee's final salary?
If the tax is due in terms of PAYE (ie you should have been deducting this tax and paying it over to SARS as an employer anyway), you don't have a choice. You must make the deduction and if the employee doesn't like it, tell the employee to take it up with SARS
If you don't deduct, SARS could look to you for payment anyway.
With it being end of financial year anyway and if the amount involved isn't too significant it could be argued as part of the end of financial year recon process.
Participation is voluntary.
