This is a bit questionable - as the seller pays the commision to the agent, obviously this amount is built in to the price. The norm is a deposit, best held in trust, should a buyer breach the contract, the deposit is forfeited, the spoils of which the agent and seller can scrap for. If I read your question correctly, with some surmising, the agent is wanting to get his/her commision no matter what. A breach does not occur where the suspense conditions are not forfilled, such as financing, obtaining lease etc, etc and hence there can be no benefit to seller or agent for this. The breach occurs where the buyer reneges and decides not interested or the buyer has misled etc, etc
