    bank account limit and sars

    if i have an overdraft facility of R100 000.00 and i am R1000.00- in my account...in other words have R99 000.00 available overdraft funds.

    if i owe sars R 20 000.00 in penalties and interest can they take it out my account?

    or can they only take it out my account if i am in a plus balance?

    considering the money doesnt belong to me...it belong to the bank...and if they do would i have a winning case to get my money back...i do realise this would be impossible...considering the rate at which officials are spending our hard earned money...on the good life

    I would guess they would take it and argue later, but I believe that removal of funds from bank accounts is quite a severe action that they only use for long overdue and serious accounts. I do of course stand to be corrected.

      That's the key right there - available funds.

      I believe SARS is being challenged by some consumer grouping on the issue of just sucking money out of bank accounts.
      Participation is voluntary.

        Here's a case related to this issue - we just had R127 183 sucked out of two personal bank accounts that had the available funds!

        SARS says we owe tax on money they claim we earned in 2011 year. We had no knowledge of the problem because they send the notifications to our tax agent. Who I can't contact until tomorrow.

        Be warned.

        This is unbelievable.

        My questions: What recourse do we have?

          To illustrate the futility of going up against SARS:
          About four years ago, a member of an elite armed robbery response unit in the SAPS, and cop of the year, told me that if they really wanted to screw Nigerian criminals, they did not assault them, they merely gave their information to SARS.

            Am truly surprised. Nigerian criminals paying South Africa taxes?
