    [Question] TAX ON CAPITAL INVESTMENT

    Please could you assist. I have client who moved jobs 6 years ago. He was then paid out a lump sum pension, which he was taxed on. He took half that money bought a home and paid R950 000 to his cousin to help him grow his business, with an agreement that he would in return receive R200 000 per year, he will be receiving the R200 000 how is this taxed and what will the best way be to do this.

    Then also, he has asked for the R950 000 back, what is the tax implications. This is his pension's lump sum, he has been taxed on it, it is his capital. If his cousin pays it back what will the tax implications be. Please advise

    Firstly, was this simply a loan, or did he buy shares in the business? I assume it was simply a loan and that being the case, the R200,000 p.a. amounts to interest received f which the first R23,800 is exempt, but the balance is taxed together with his normal income.

    The repayment of the R950,000 capital amount is not taxed.
