Leave during notice period

    [Question] Leave during notice period

    Hi forum experts

    I am currently 2 days into serving my notice period. About a month ago I sent my manager my leave plan for the rest of the year as he requested in order to do proper planning. A week ago I formally applied for annual leave and thereafter I would be returning for a week to serve out the remaining notice period. When I submitted my resignation letter he mentioned that he needs to speak to HR about my leave, but would approve my leave in any case. A few days later and my leave has still not yet been approved. Where does that leave me? Could I be regarded as having absconded if I go on leave or what legal grounds would I have to counter that argument?

    If they don't approve the leave, they're just going to have to pay it out on termination anyway.

      Understood, but I really couldn't care about the money. I need the leave as I am burnt out.
