    Bargaining Council behind with hearings

    I was unfairly dismissed from two companies in March this year. In April I submitted an application to the Bargaining Council for conciliation. It is now July and they still have not set a date. I heard they are +- 1500 cases behind, due to financial problems. Does anybody have the same problem and when do you think I will get a date. I want to get this behind me and move on. I cannot find work because of this hearing and employment agencies want to know what the outcome will be. It is depressing and each passing day, moves me closer to hell.

        They're in dire financial straits, which is probably the actual reason for the delay.

        Perhaps lodge an application that on the grounds that the unreasonable delay is prejudicial to you, that your case is transferred to the CCMA who can expedite it timeously.

          Thank you, that is a great idea, I am going to try and get this transferred immediately. I will let you know the outcome.

            A quick update, MEIBC have set the date for later this month, the case will go straight to arbitration. I am still waiting for the other case's date.

                I actually worked for three companies that were under the same umbrella, and was paid by each company. The one company suspended me and held a disciplinary hearing, and dismissed me from all three. However, the one company said it was unfair and gave me my job back. I took action against the two as it was an unfair dismissal.

                    I had hoped at worst making an application to transfer the case would bump you up the queue
