    [Question] Garnishee Order

    Hi

    Scenario:

    Owner Franchise Manager has a garnishee against him for maintenance. He instructs the payroll person to ignore the garnishee. Because he is the owner/manager the payroll person ignores the garnishee. What recourse does the lady not receiving maintenance have?

    It is easier to go for the owner to honour the garnishee order, than trying to go to the maintenance court to get him to pay maintenance.

    I am not a lawyer, but I think that ignoring the garneshee order is an offence, and the owner of the business is personally responsible for payment of the garnishee order.

    I am sure our leanered friends on this forum will provide better information.

        Hi Cindy, if I were the mother, I would report this franchise holder to the Franchisor. A certain retail group recently received a lot of unfavourable publicity due to the illegal actions of one of their franchise holders and I think the head office would be well aware of this and very sensitive to it.
        When matters are left unattended, chaos ensues!
