    Labour Court Costs Against CCMA?

    I have a review case open at the Labour Court against the CCMA and was hoping for some advice as how to proceed regarding costs. I believe that we have a strong case. The following is a excerpt from the response from the CCMA.

    1. We note from your review application that you have sought a cost order against the CCMA and the Commissioner.

    2. In light of the above we request that you advise the CCMA in writing, within 48hours of receipt of this letter as to whether you stand by your notice of motion or whether you will withdraw you claim for costs against the CCMA and the Commissioner, failing which we will have no choice but to file a notice of intention to oppose the review, more specifically the costs order requested, in which notice notice we will also seek a cost order against yourself.

    Please advise how I should proceed bearing in mind I think my case is very strong. Thanks

    Surely you're not going to Labour Court without legal counsel???
    When matters are left unattended, chaos ensues!

      It is unclear what your application is about.
      You speak of a review for costs - against the CCMA.

      A review would normally be against the decision; the CCMA and commissioner would be cited as parties, with costs sought against those who oppose.
      A party may bring an application (but not a review) against the CCMA for costs in the court - although it is most unlikely to be succesful.
