[Question] Need help (I want to leave work during probation period)

Hi, I need help.

I want to leave work during my probation period.

Firstly a few things, I signed a contract. It states I'm permanent, it also states that I'll be on 3 months probation. The notice period in the contract is 3 months. I have not yet received a letter of appointment nor do I have a copy of the contract I signed.

I have only worked for less than 2 weeks.

I have tried contacting HR to say I wont be coming back to work but no one was available.

Can I just leave work without any repercussions?

Never leave a job and burn bridges never. Rather camp outside the HR office or the bosses office and sort it out. Whether it is legal or does not matter you don't want to get a reputation that you just quit.
Then also learn to never start a job until you have a copy of the contract. You never know when this will bite you.

It depends on the contract - and whether the contract is fair... perhaps a whole lot of things come to think of it.

But in a typical employment scenario, it normally isn't worth pursuing legal action.

If we're talking about something where there's serious money in play, like being signed up as flyhalf for The Sharks - probably a very different story.

BTW - Ian gives good advice too. Don't just desert... The world can be surprisingly small at times.

I think there is no problem in leaving the job during probation period as you are not bound in any contract. There are not any legal issues also that the company perform against you. All that you have to loose is your salary. But I think the best option is to talk to the HR regarding the problem as it might affect your reputation. Effective communication is always the best solution for every problem. Go for it and you will definitely get something better.

Best is to have a sit down with your HR department and discuss your concerns and the reason you wouldn't be creating any future relations with the company. I've had a couple of staff members in the past at various companies of where I was involved that left them in a difficult position after just leaving us within their probation period as an engineer they had use us as a reference and one in about five got the new job the rest came back asking us to reconsider their position with the company
