    [Question] Restraint of trade agreement

    Is anyone aware of the terms surrounding ROT.

    Recently I was dismissed immediately upon my employer finding out I had plans to start up my own business within the same industry. Upon discovering this, my employer fired me immediately and without notice. Does this render the contract/rot null and void?

    The terms are per the contract, provided they are enforcable. (Check the "similar threads" box below to find some of the previous discussions on TFSA regarding this).

    Termination of employment does not render the entire contract "null and void."

    The first question to answer though is "Was the dismissal unfair?"
    Participation is voluntary.
