    seeking legal advice on civil matter

    Hi, I'm Nasiphi


    I have been looking for legal advice. I'm a candidate attorney from a small law firm. Our client is the defendant in a case where she was served with summons, we send the Notice of intention to defend the case in time and after we serve plaintiff's attorneys a defendant's plea to the plaintiff's particulars. so its been a long time and the period has elapsed the plantiff have not deliver anything. what should we do on behalf of the defendant?

      First a business question - does your client WANT to proceed any further? Usually if one receives a summons one is all to happy if the plaintiff forgets about the whole thing and we all go home in one piece. So does it make business sense to proceed with this??

      If so, then you need to take the further necessary steps to prepare your client for trial including requesting the plaintiff to discover, amending pleadings if necessary and finally you request a trial date - ultimately you force the plaintiff's hand by compelling him to finalise trial preparation and then compelling him to attend trial and to run his case.

        Did you check with someone at the law firm you are working for?
