    [Question] Re. Pty Ltd / CIPC > Notice Refusing Name Reservation

    Maybe someone here can help me.

    My boss wants to convert his CC to a Pty Ltd and 3 names were proposed which was flatly refused.

    Weird thing is none of the examples listed on the letter received actually matches our preferred name, which we're trading under these last 7 years.

    Is there a way to object to the Notice Refusing Name Reservation?

    You can appeal to the companies tribunal if you believe the name is sufficiently unique.

    Another thought though, why change the name after 7 years? Converting to a Pty is a sound decision, but why change the name?

      Hi Clive,

      I don't know what my boss' intentions is, but he wants to basically convert from CC to PTY and wants to maintain the t/a name, so that'll become the "new" name.

      Also, which form must I download from the Companies Tribunal's website?

          Okay, I sent a completed CTR142 along with the COR9.1 via e-mail to the Companies Tribunal yesterday and got the following response back:

          "Please see below documents to be included in your application:

          · Form CTR 142;
          · sworn statement or affidavit setting out the facts on which the application for a determination in respect of a registered company name or reserved company name or a defensive name is based;
          · extracts from the records of the Commission reflecting the registered or reserved company name or defensive name; the registered office address of the respondent company and its principal business;
          · proof of authority where the deponent is acting on behalf of a juristic person or corporate body, and
          · proof of service of the application on all interested parties in any of the methods stated in Table CR3 of Annexure 3 of the Regulations.

          The list of documents above is available in the Companies Tribunal Practice Guidelines which may be obtained from our website at www.companiestribunal.org.za"

          So what do I do now? All this stuff is greek to me. Is there someone in the industry that provides the necessary service to assist with the above?
