    Question IRP5 for the Employer?

    Don't know if I'm posting under the right forum for my query...

    I'm in the middle of doing all 4 (3x CCs and 1x Sole Proprietor) of my boss' companies' Employer Reconciliation Declarations (EMP501s) as well as the IT3(a)/IRP5 that's required for all the years that SARS are looking for.

    I've started working for my current employer in March of this year, and believe me when I say that everything's like 2 years in arrears.

    Anyways, one thing that was brought to my attention was that I'll have to issue my boss an IRP5 as well (for all his owners drawings, salaries or whatever they call it).

    So how do I go about?

    the best thing to do is get a follow up from SARS to understand what is outstanding from the company ... you would also find that if the company is that far behind that it may be investigated , so play it safe and get the info from the horses mouth before you mis represent yourself ...

    Have the CC's been deducting PAYE off these "drawings" and paying them over to SARS?

    If not - you'll need to issue IT3a's instead of IRP5's with the cc's.

    When it comes to the sole proprietor enterprise, if no PAYE has been paid over for him, you need do nothing. That all comes out in the wash when he submits his annual tax return. If PAYE has been paid over on his behalf, you'll need to issue an IRP5.

    From the e@syfile point of view, you add the boss just like any other employee, except he might be a category C individual (depends how you describe the income). The e@syfile software will warn you if you need to change him from a category A to a category C when you post the income source.

    My actual concern was regarding the issuing of an IRP5 / IT3(a) for the boss as well, which Dave has (thankfully) clarified...

    Dave, that seems to be the case...

    I'd like to know, I have to add the company that he's trading as a Sole Proprietor on e@asyFile - do I add the co. (under Employer) as an Individual?

    Sorry about the delay in getting back to you...

    If there is no sole prop. option, then the answer would be either individual or partnership with a single partner. What you probably would like to ensure is there is still a trading name attached to the profile.
