    Tax

    Hi There

    I worked for a company that was not VAT registred, I need a IRP5 from them,
    he keeps advising that he will send it, however I dont think he can.
    How do I now submit my tax return ??

    Sorry, I'm not understanding your post. Why would it make a difference if the business was VAT registered?

    Did the employer deduct PAYE?

    Tax

    He deducted tax, the issue for him not being VAT registred he sells consumables and a turnover of more than milloin per month. He liquidated a CC then opened a PTY , for the same business. The liquidation was to get out of the problem.. I think he still has a problem and therefore cannot give me a IRP5, How do I submit my tax return without the IRP5 , Can I write a letter and explain that period , he also never gave payslips.
    When I resigned I asked for it, he sent me a excell spread sheet for the 3x months
    Left because things were not right , could not develop the business - I was the Business Development Manager .. was a joke !
    He said on the e-mail with the excell spread sheet that tax will be paid over, I dont think he could pay it over , because there might be a query from SARS.. I advised them of his conduct.

    The plot thickens............ It is an offense to deduct PAYE and not pay it over to SARS ! The owner/member/director will be held personally liable to SARS for the amounts deducted from the employee.
    Dave can correct if I am wrong but he will not be able to issue an IRP5 if deductions were not paid over.
    I think he is in for a rude awakening !

    As long as the spreadsheet reflects the PAYE deductions, I would hope this and a sworn affadavit by you as to the reason for a lack of IRP5 might serve you well.

    There's still a chance that your previous employer has actually gone through the annual recon process - you'll know when you get draw your tax return in this year's filing season as the IRP5/IT3a should be listed already.

    If it isn't there I suggest you will do well to go into a SARS office to file your tax return this year, rather than try to do it online or anything like that.
