    Labour law regarding paying people by comission only

    Hi,

    I would like to pay freelance telemarketers on commision only. They will work their own hours on a parttime/fulltime basis from their own home/office and I will pay them their agreed commission at the end of each month when I have received payment from any new customer and the funds have cleared.

    I would please like to know if there are any specific labour laws that I need to be aware of and whether it is necessary that I provide an employment contract, notice period etc.

    I will just require that they keep the sales leads and customers confidential and that they act in the best interests of my business which is currently operating as a sole trader.

    I would also like to be able to alter the commision agreement or withdraw it at any time in the future (ofcourse any commision owing as per original agreement will be paid)

    You will certainly need a contract in place, although not an employment contract. It might be an idea for you to look at how the estate agent industry typically contracts with their agents.

    Arranged correctly, you would probably just have to pay attention to tax deduction issues.

    ...At least as matters stand at the moment. This seems to be the year for a number of employment related legislative revisions, but at this point they're drafts and not in force.

    Thanks for pointing me in the right direction.
    I've managed to find a real estate salesman agreement and a general commision sales agreement template online.
    I would appreciate it if you could elaborate a little further on what tax deduction issues I would need to pay attention to and how they relate to agent.
