    help with basic contract of employment

    I am just adding in a few bit's and pieces into the basic "contract of employment" , it's for shop staff. Can anybody think of anything else/ or worded better. Cheers. One other thing - they normally work 5 and 1/2 days a week, the 1/2 day, if taken, would count as a whole holiday day - or would it count as 1/2? And how many days am I required to give as holiday - the usual 15 or more as they work 5 and 1/2 days? cheers again,

    opening a bussiness was easy compared to the HR I need to learn, it's a bit off putting

    Job description

    Help customers make their purchases in a friendly, helpful, courteous manner.
    Help with keeping the shop clean, tidy and organized. Tidying includes stock, fittings and windows.
    Post, pack and send items for website sales and returns.
    Ensure, to the best of your abilities and not letting any harm come to yourself, that no shoplifting takes place.
    Operate the till in a friendly professional manner.
    Help with the pricing and checking of all stock deliveries.
    Help with taking stock.

    Other conditions

    Do not bring any valuables into the store: ***** cannot be held responsible for their loss, damage or theft.

    Cell phones are to be switched of during working hours. The business phone is for work related calls only.

    Staff must stand and assume a friendly attitude when customers are in the store.

    You are required to notify ***** of any change of circumstances and personal information as soon as they come into effect.

    The dress code is casual but not revealing in any way.

    2nd jobs are forbidden during working hours. Written permission is required for second jobs outside normal operating hours.

    We reserve the right to search any bags and personal property if theft is suspected.

    I have a basic contract but it is 8 pages if you want it.

    Please make sure you stay within line with Sectoral Determination 9. You have a minimum wage.

    cheers for that bbbee - would you happen to know what the minimum wages are. we are in a rural area. I did find something a while ago - but it was for a few years ago and cannot find anything current.

    The Department of Labour lists sectoral determinations here. The one for the wholesale and retail sector is near the bottom and should be the latest applicable.

    There are only two areas now in SD 9. There is a copy in the Toolkit. The minimum wage changed half way through this year when the DOL decided to rid themselves of areas c through e. The TBVC countries have been removed as have the companies with less than 5 employees. Don't be fooled by this determination. There is another determination that overrules this one if you or any other company has less than 10 employees. Ministerial Determination 1: Small Business. Also found in the Toolkit.

    By the way there is no longer a separation of rural and suburbia areas.

    Does the wholesale and retail sector determination specifically mention it is overruled by the small business determination? I noticed that in terms of the small business determination this was required for the small business determination to have precedent over any other determination.

    Leave is a consecutive 21 days. So people working a 5 day week, get 15 days + the 6 days weekends. People working 6 day week, get 18 days + 3 days weekend. your guys get 16.5 days + 4,5 days weekend. The net result is the same. The confusion is the concept of 15 paid days. The non working days are considered unpaid. So your wek wage is divided by the number of days you worm, net result 21 consecutive days.

    There are determinations within the MD1 that cover study leave and family responsibility leave. These are included in the annual leave granted. I have the full determination.

    Please remember that all clauses are by agreement between employer and employee.
