    Get Commission but no overtime then

    My son's work wants them to do sales now. They are WIFI/mobile network technicians.

    So they are offering them commission but say in the same breath that because they now getting commission they will no longer be entitled to Overtime.

    So is this legal? Or are they taking a chance? I can't find anything online that covers such a scenario.

    I'm thinking that they can only do this through a consultation process and if my son agrees to this after the Consultation

    Imagine - doing 10 hour overtime doing the Technical part of the job but you don't get paid and you don't make any sales. I'll also add that no dedicated time is allotted for the technicians for sales. It must be fitted in during the normal duties

    Any change to working conditions needs to be negotiated between the employer and employees. On this you are on the right track.

    The problem with a mass change where an entire category of employees are affected is that you (your son) will likely struggle to successfully negotiate this down to the individual level. The affected employees will likely need to negotiate on terms as a collective.
