    Annual Leave days for Half Day Worker

    How many annual leave days is a half day worker entitled to - working hours 8h30 to 1pm = 4 and a half hours per day?

    Ref: Basic Conditions of Employment Act

    19. (1) This Chapter does not apply to an employee who works less than 24 hours a month for an employer.
    (2) Unless an agreement provides otherwise, this Chapter does not apply to leave granted to an employee in excess of the employee’s entitlement under this Chapter.

    Annual leave

    20. (1) In this Chapter, ‘‘annual leave cycle’’ means the period of 12 months’ employment with the same employer immediately following—
    (a) an employee’s commencement of employment; or
    (b) the completion of that employee’s prior leave cycle.

    (2) An employer must grant an employee at least—
    (a) 21 consecutive days’ annual leave on full remuneration in respect of each annual leave cycle; or
    (b) by agreement, one day of annual leave on full remuneration for every 17 days on which the employee worked or was entitled to be paid;
    (c) by agreement, one hour of annual leave on full remuneration for every 17 hours on which the employee worked or was entitled to be paid.

    So the answer is thus (2)(c) ?

    I would think so. It's the one that I would use in this scenario, but the legal guys on this forum might have a different opinion.

    In my opinion it is three weeks of 4.5 hrs per day.

    According to the labour law in South Africa, every labourer is entitled to 15 leave days per annum if working five days a week and 18 working days per annum if working six days a week.If you want to check for part time labourers, multiply 5.6 with the number of working days in a week, you’ll get the result.

    The Act in Section 20 actually says:
    (2) An employer must grant an employee at least-
    (a) 21* consecutive days' annual leave on full remuneration in respect of each annual leave cycle; or


    * Includes weekends, in other words 3 weeks
