    Unpaid Salary, UIF outstanding Payments

    Good Day

    I'm owed April and May salary from my employers.
    Because of the Corona Virus I took it slow and told them I would fill in the papers to submit
    and receive my UIF Payment.

    They then told me UIF payments is outstanding. So UIF won't pay anything to me.
    My payments to UIF has been subtracted from my salary for the last 5 years.

    What route can I take to address the issue.

    They failed to make UIF payments?
    Or have they perhaps made payments to SARS but failed to submit UIF returns to the UIF?
    (Or as some employers have found, they have submitted the returns but UIF have not captured them completely and/or uFiling is misbehaving).

    I read a report (somewhere) that in situations where the employer has deducted UIF but failed to pay it over/declare it, UIF is going to pay out the TERS claim to the employee anyway, and chase after the employer after...

    The problem I see with relying on this is even if it does happen, I can't see it happening anytime soon. Here's why:
    • The UIF is going to have to develop a process.
    • That process is going to require some level of proof from the claimant (submission of pay slips as example).
    • I would expect each claim is going to have to go through some sort of validation process as there is a pretty significant risk of fraudulent claims.


    The killer to my mind is UIF is clearly already struggling to process all the stuff that is on their plate as it is. For example:
    The May TERS online application window was supposed to open yesterday. As of posting, it still has not opened.
    I am aware of a significant number of what appears to be valid claims which have sill not been paid out, with no apparent valid reason.
    I am getting feedback that applicants for maternity benefits that were made in March are yet to see a cent...

    Lots of great theory being put out at the moment, but it seems UIF is having trouble putting it all into practice.

    Anyhow, just clarify with your employer as to whether they paid over the funds and it's a returns issue...
