    Angry Can a employer not pay your final salary if you are dismissed for suspicion of theft?

    Hi All

    I need advice.. My husband was placed on paid suspension pending a hearing 1 week before his payday. the hearing was then held on his payday and he was informed that employees who is facing disciplinary hearing only get paid on last day of the month.

    My husband was then informed 3 days later that he was dismissed and he would not get any salary or leave paid out to him.

    Is this legit?

    Please help...

    All things being simple, the short answer is No, it is not legit at all. The employee is entitled to pay up to and including the date of dismissal.

    However, one scenario that does come to mind which could complicate things is if there is a loan owed by the employee to the employer.

    So the longer answer is the remuneration (including leave benefit) continues to accrue during the suspension up to the date of termination of employment. Just how much will actually be paid out may be subject to other issues.

    Maybe ask for a written confirmation stating the grounds that he will not be paid on.

    Also request this in writing...
