    Unpaid Sick Leave

    Good Day
    My employer decided to deduct R1024 off my salary this month for unpaid for last year feb. An audit was done and i had to sign a warning for excessive leave taken which was 13 days and not doing my return to work documents. No trends were picked up and i still have 11 days left but yet i had to sign a warning. We went through a section 197 in Feb 2016.Roughly that time we changed payroll systems twice but now i am thinking that they cannot access the old one. As my documentation was submitted as my return to work was done by my team who is now on maternity leave. Can they do this?

    How long had you been working at the company when you took 13 days leave ?
    How much sick leave have you taken since ?

    Not sure how you get to the figure of having 11 days "left"

    Perhaps you should explain a bit more ...... remember sick leave is not like normal leave ...... you are entitled to a certain period over 3 years - its not leave that you must take or try to take.

    Taswell .... I have also noticed that back in 2008 you had issues with a company that dismissed you ? And then you had CCMA issues. And now again you have a problem ? How come so many problems

    When was the warning issued?
    Did the warning state that some days would be treated as unpaid?
    How many days were unpaid?

    Two incidents in nine years and that's a lot of problems?

    Dave how many incidents like this have YOU personally had in your work lifetime and gone to the CCMA ?

    HR, I haven't had a boss to answer to (other than clients) since 1985.

    From the recruitment point of view - 99% of people do not have once incident ever in their career, let alone 2 incidents or 3.

    What percentage of those candidates have ever been through a Section 197 process?

    Hard to say but probably a low percentage.

    Good Day. Sorry for the late replay. i was just taken a back by your response about the last case.
    Honestly it did not sit well with me. 9 years on and i am still struggling to rebuild my life.
    On Thursday i had a meeting with HR about the matter and said that they will investigate.
    Today i was called into a meeting and they told me that they are going to reverse the transaction regarding the unpaid sick leave and pay out will occur on payday. My challenge is that the money they took has impacted me heavily. I spoke to them and explained that I am going to have a transport issue because of the finances they took. Also my query was lodged before cut off date which was the end off March. I have also spoken to my Ops Managers about my situation. Which one them loan me some bucks to get home but had to make a personal commitment to pay back which i will do. Today i must do the same thing. I dont think its fair that i must go through this and stress everyday thinking how and who i must ask for money to get to work and back home. They made the error but its expected of me to be at work. Please advise as i really need help.
