    Annual leave part of company year end shut down

    Someone just asked me this question. Employer's deducting staff annual leave from the company shut down period. The company shuts down for about 3 weeks in December. Is this right? In other words he cannot take from his annual leave during the year...

    Yes it is right. But normally a company might run on skeleton staff and split their leave. We also shut down and tell our girls when we hire them that this is part of their leave. Its their right to accept it or not.

    Thinking about it just seem a bit unfair in my opinion. It's an "obey or else find yourself another job" situation. There's no flexibility..

    A staff member should be able to take his leave or some of it during the year despite the company annual shutdown. I personally think staff leave and company shutdown should be separated...

    Plus: On the subject of it being "unfair". Do you think it is fair that the company should be expected to hire temporary staff when the employee takes leave mid year, and then still pay them to do no work during the shut down period? The whole point of the shut down period is so that staff can take leave every year.

    To tone down what might come across a bit abrupt above, many companies offer a hybrid where they shut down for say two weeks at the end of the year and the allow a week to be used during the course of the year. There is almost always a compromise solution.

    Do you think hey ? Maybe your friend should speak to his employers then ? Maybe they can wrangle the 15 days leave at shutdown and another 15 days throughout the year.

    Many companies close at year end, and have their annual leave during this period. Most employees I speak to are extremely happy to take leave this time of the year, because of the number of public holidays, and if public holidays falls on a weekend, extends the leave days further. This is also the time that schools are closed.

    Unfortunately when you are employed by a company, you must abide by the company rules, if you do not like them, you are quite welcome to find another employer.

    Anual leave on shut down period is normal and "sound"
    Such people must feel free to go open their own business if they do not agree with the business needs
