    Smile Business name, registration and other legal issues

    Good morning guys,

    So I am in the process of starting a business. Still busy with Market research. Doing the industry analysis, competitive analysis and strategic planning.
    I want to start creating a physical presence of what the company will look like for my partners.

    So we have a name and some Brand imagery(Colours, Logo, theme, ext.).

    I found out that another company exists with the same name in Argentina, but its a different trade and industry then my company.
    This company has limited global awareness.

    Do I have to change my company name? are there any legal issues to trading with a name that already exists?

    No sugar, but actually went for another job interview with them. They chose someone else for that specific team. I have two other generic interviews nextweek.

    Any comments on this specific thread Kevin?

    No real comments ....... we have all already commented on previous threads. But I could suggest that if you want to start up your own business you search this forum as this has been discussed in depth before

    @RandomHero,
    I don't think you have to worry. My company name is the same as an American Trade organisation and haven't had a peep from them. Just have a backup name ready and you will sleep easier.
    Only stress when you can change the outcome!

    Thank you Ian. but I do not want to spend thousands on my entire corporate identity and then be faced with legal issues.

    Are you allowed to have a registered name if you work in a different industry?

    Corporate identity should be low down on your to do list. Choose a name choose a nice font and use that. Your professional logo should be looked at after a few years.
    I would look for things like retro, stencil and hipster fonts.
    Your best marketing should be word of mouth and good service.
    Only stress when you can change the outcome!

    The worst that can happen is that they may ask you to change your name. Any legalities or actions will only start if you refuse such a request.
    Being in a different industry already puts a different angle on a similar name.

    Branding is very important and the name and logo is your identity for the rest of the existence of the business. The best name is one that resonates and is easy on the tongue, but also describes what you do in one or two words. Think Microsoft or Coca Cola. The name is the brand and immediately creates a perception in the mind.

    This is the way to go for corparate ID.

    Thank you for the Advice. i have some friends who are knowledgeable in business law. I will get some free consulting from them haha.
