Thread: How to handle a totally untrue allegation at CCMA

    Well, all went well. I kept my story calm, short and to the point. An hour after we started and the commissioner had his one on one with each of us, she withdrew the case. Must say the commish tried his best to talk me into some sort of settlement, financially. I however decided I will walk the distance if necessary, as a win to the employee on this type of thing will just encourage more of them to try the same.

    One thing worry me. I was criticized on the format of the resignation letter. Apparently I should 'make' the employee say in it that the employee is resigning out of his/her own free will and that he/she was not forced or coerced to do so in any way. This to me does not make sense, as the employee will still just claim he/she was forced to say that? Was this just a tactic to make me think I might be in trouble?

    What should the resignation letter contain?

    Good news - sense prevailed, often in these case it does not. And well done for not settling. CCMA is so often seen as a way to make a quick buck - as it was for many.
