    SA Citizenship status after divorce

    Hi All,

    Any legal minds to assist on below case.

    Mr "A" marries a lady (Mrs A) from swaziland for 8 years. They are now getting divorced
    What will happen to the citizenship of Mrs A now?

    Your question may be misdirected.
    Marriage does not make a person a citizen.
    Marriage, after 5year's entitles a person to, permanent residence status.
    After further 5 years you can apply for citizenship.

    Pr and citizenship can also be obtained through kinship, so if there is a child then it is best to pursue PR through kinship rather than marriage

    My German colleague has been here for 8 years and she has been married to a South African for 10 months. Her work permit keeps getting messed up. Home affairs pleads innocence because she is now forced to pay a 3rd party to handle the visa. The 3rd party claim that it is not their problem because home affair keeps messing it up.

    Is there a way to short circuit the issue and speak to one person who is able to sort it out without having to bounce back and forth between the two entities and pay R1.5K each time they supposedly handle it?

    The third party is the new amendments creation, VRS.
    They merely collect forms and forward to Pretoria, DHA must process and issue.
    I am more inclined to believe that Pretoria is to blame.
    You have to go through VRS though. You need them to show that they sent it to Pretoria.

    VRS seems to be just another job creation / money skimming exercise because they do nothing more than carry documents back and fro. She says that they are unable to advise or assist and that they simply tick off whatever is on the checklist that DHA gives. DHA says that VRS messed up and VRS says that they take no responsibility. The problem with VRS is that each time she deals with them she has to pay and go through the entire rigmaroll all over again.

    Yes, it's absurd.
    The intriguing bit is that VRS falls under the consumer protection act and in time that may be an interesting attack.

    I also totally agree with Sterne Law. There is no link up with the marriage and the citizenship. A person who is married for 5 years can apply for the permanent residence certificate. Then after 5 years, can apply for citizenship. Thus, divorce cannot affect the citizenship of that person.
