    Employer's Checklist on Employee's Resignation

    Hi, we had an employee with us for a period of 10 months. He came to the company in order to gain some work experience (mutual agreement), and we also agreed that if he found another job where he could get training and advance in his career that we would let him go immediately. I'm happy to say he did, and is now working for a company where he can work his way up. My question is... what do I need to do by law to take him off our books? Is there a checklist available so that I'm sure I've removed him from UIF etc?

    The most important of all is to get a handwritten and signed resignation from the employee, everything else will fall into place.
    This will safeguard you in the case he finds himself unemployed and then goes to the CCMA and claims unfair dismissal.

    1. Issue a certificate of service on the company letterhead. It doesn't have to be anything fancy; something simple like this will do:

    Certificate of Service


    This serves to confirm details of employment by this company as follows:

    Name:

    ID number:

    Position:

    Period: 15th March 2004 to 31st January 2011.

    Cause of termination: Resignation.

    Salary at termination: R10000.00 (ten thousand Rands) per month.
    2. Update UIF; the easiest is to do it via uFiling.

    3. You will have to issue an IRP5 or IT3a at some point; make sure you've got all the information you will need.

    It's also good form to give some sort of testimonial, provided you are happy to do so, of course.

    And make sure that you've got that resignation in writing!

    Justloadit and Dave A, thank you so much for the responses. I do have a signed letter of resignation, and will follow the other steps as advised by Dave. Much appreciated. Will work on that straight away! :-)
