Thread: Got Fired without notice, any help would be greatly appreciated

    So me and my wife been to concilliation meeting on the first of November. The CCMA combined our cases as we have been fired on the same day and from the same employer. We were in there for 7-10 min before the commisioner ruled. He found that both my wife and me have been automatically unfair dismissed and gave us a certificate to go to the labour court. Can anyone tell us what to expect at the labour court?

    Whoever replies, please also explain why it was referred to the labour court straight away. Why did the commissioner not make a ruling there and then? How does these things work? Or was he just passing the buck? Or is labour court the same thing as arbitration? I thought from conciliation you go straight into arbitration, also at the CCMA, with the same commissioner? I understand that one of the parties can object to going on immediately with arbitration and that they can then appoint a new commissioner for when the arbitration proceed. But why Labor Court? What is Labor Court?
