I had a question concerning the ownership of a domain I am using and after posting and PMing sneakie he replayed with the right answer and with his permission this is what he said and the answer I was looking for but was struggling to find:

Whoever is listed in line 2a is what determines who the legal owner of the domain is.
If you want to move your hosting to another ISP, then get the new ISP to do the transfer for you. Normally this all has to be done on/in a document with a letterhead etc. and needs to be signed by the Registrant as per line 2a.
They will send a request to the person listed as the admin (line 4g). This person will then respond with either "allow" or "deny" If he replies with "deny" then you have a dispute but they dont have a leg to stand on and your new ISP can help you "TAKE" your domain by completing the forms available from the co.za site.

Once the domain is moved you can then request that your email address and details are put in for the admin and technical contact, but this is not required, It is best to leave those with the person you are most comfortable with.
