    debt

    I was retrenched about 5 years ago and send alll the relevant documents to all my creditors. Nothing happened for almost 5years and now one of them is threatining me with a summons/judgment.
    What does that mean? Can they come take all my furniture and stuff? My husband doesnt know about this debt.What can I do?

    Hi there,

    I'm pretty sure this debt(s) are eligible for extintive prescription i.e. extinguishing a debt or cancelling a debt by the passage of time! I appreciate that you feel like you on trial for murder and further that it can be traumatic to be treatened with summons etc. The law is now clear, if it's a personal loan, credit card, vehicle finance, retail apparel account etc, the creditor must first issue you with a final demand letter before sueing out summons..anyway, you need not even pay anyone to claim extinctive prescription for you, you can do it yourself!!!!     Agreed.

    Unless it is a Municipal rates or tax claim, or the result of a Court order, there is no way they can do ANYTHING!

    Admit nothing. Pay nothing. Just claim prescription.
