    CORPORATE SABOTAGE - ADVICE NEEDED

    Hi Guys

    I need some advice...
I landed a fairly lucrative government tender last year...
it was actually a service provider tender..
this tender is issued for a 12 month period..
the previous company had this tender for about 10 years before I got it...

    my problem starts here :
I gave a report to the heads of department for work to be done that does not fall part of my SLA
so the authorised people called in some companies including myself..had a meeting on what needs to be done
    everyone was happy and left:
Today I found out that all the problems that I reported had been fixed this morning by the previous service provider????
they had no authorisation to touch the system...
it is my site to maintain ...

    IM FURIOUS BEYOND WORDS!
is there any recourse for me???
from where i stand i think that these guys went in and sorted out these problems just to make my company look bad..!

    please advise

Well, government tenders! You should be a BBBEE company to have landed this, with a lot of disposable income to new founded "friends". Seems like you do have the first requirement, but not the latter. It is tough, and unless you do not have the latter, you are doomed! Unfortunately.

    Watch out for future sabotage.

In future, do not explain exactly what the problems are or the exact solutions. Try be as vague as possible.
This happens in all industries, they come to you for a detailed quote, and then take it to their buddy, who simply looks at your quote and drops your price a small amount, and they get the job, with the plan from your quote to do the job.

You have to learn the rules and be streetwise before you can do business with government.
Lesson no 1; do not trust anyone.

I think the topic title 'CORPORATE SABOTAGE' is overstating this somewhat. Your competition is called your competition because they're competing against you in the same business field. It looks like your competitors just won this round, what the reasons were I'm not sure. If the work was outside the scope of your SLA they were entitled to use who they like, if you feel something underhanded went on you'll have to find proof.

Having done it at no charge is their attempt to show good faith, however if the SLA is based on a tender, there are no brownie points that get accumulated to make any tenderer more preferential than others if it is based on cost.

I think that pretty soon, due to the so called revolution my the middle class against over payment to any services, the eToll is a very good example of this, which directly impacts on the amount of so called punitive taxes charged, will create a situation in which the municipal departments are going to have to look at SLAs based on performance and price, rather than awarding to whoever has the most BEE points. The BEE system is not working, and is being detrimental to all in RSA.

    So hang in there.
