    Outstanding Income Tax Returns

    Hope somebody can assist me with outstanding Income Tax Returns.

    I have a friend who is unable to submit her tax returns for the last 2 tax years as the company she was previously employed with did not submit their EMP Reconciliations’ to SARS. On her efiling profile there is no IRP5 certificates’ for the last 2 tax years.
    Since discovering that no reconciliations’ were submitted to SARS, she tried contacting the company. Unfortunately for her the company had already closed down. However she still has all her payslips dating back to the tax years in question as well as bank statements reflecting the salary transactions.
    What would be her best option in getting her tax affairs in order?

    As it stands she will pay penalties so she needs to do her tax returns asap. I would go into one of the SARS offices and see what they can do. I've logged calls with SARS twice and both times I still had to go to their offices. That's what I would do, I hope someone else knows exactly what needs to be done.

    If your friend has all her payslips it shouldn't be too much of a problem. She would have to make a sworn affidavit and take that with copies of all her payslips to her nearest SARS office - they should be able to assist her.
    If she doesn't have any/all her payslips then I would suggest that she obtain copies of all her bank statements for the period in question, draw up a schedule, obtain a sworn affidavit and take all of that to SARS. As Nickolai says she will still be liable for penalties though, but it's best to bite the bullet now and get it resolved sooner than later. Good luck!

    Income tax is the important aspects of government income, these guys are doing good.
