We won this arbitration, and the employee was re-instated.
That merely implies the offence was deemed not suitable for an instant dismissal.
However, was the employee sanctioned in any way - or is this now deemed totally acceptable behaviour and we can expect clowns serving us everywhere from now on?

My sense of humour extends to asking the joking employee if he likes sex and travel then telling him to effoff

I can see this ending badly for the customer…

That said congratulations on the victory… Truly well done

Correct, it is not a statement that the behavior was acceptable, but that it did not warrant dismissal on a first offense.
The posts, [and the very reason I posted the scenario] indicates that it was a very subjective "action", some would find it funny others not. Some may find it funny one day but not the next.

We did propose to the company prior to the matter coming before the Commission, that the dismissal be withdrawn and an alternative sanction imposed. They refused.

I would only be impressed in this scenario if the attendant was Paris Hilton. That said, I would feel very offended in these scenario's as I don't believe that management would condone such poor customer service!

If I may was there any company policy at work here on the company's behalf maybe?

    Something out-lining offensive behaviour maybe?

i will list a few scenarios and would liek to know if any offend you.
You are a gambler in the casino, you have not lost or won money and are not inebriated. You are thus a reasonable person.

You ask why the machine is not accepting your money - the attendant replies "perhaps the ink is still wet"
You ask which machine is paying the best - the attendant replies "the ATM"
You ask for a light - the attendant points you to a light on the ceiling
You hand the attendant a R20 and ask the attendant to break it for you - the attendant tears the note in half and offers both back
You ask for a hand - teh attendant starts applauding.

Would any of these, in most circumstances and on most occassions, offend you?
I love humor and it wouldn't hurt me. and vice versa. I would even joke smarter and more interesting in response if I had the desire to show who is who.
