Sick day 3 year cycle and very sick employees

    Sick day 3 year cycle and very sick employees

    As I understand it, an employee is entitled to 36 days of sick leave over a 3 year period. What happens if an employee uses up a lot of that leave in the first year of employment? Can the company use its discretion and rather consider the days as unpaid leave or MUST all sick leave be applied first?

    It becomes unpaid sick leave for that cycle.

    If it continues then you should get in a HR person, as it may be that the employee concerned may be unfit to perform his duties that he was hired to do.

      It would be 36 days if you're working a 6 day week. A 5 day working week would mean 30 working days sick leave in a three year cycle.

      The suggestion of getting someone with a strong HR background involved at this point is probably a good one. If it carries on this way, clearly there are problems looming. Some serious counselling and exploring of options is probably due.
      Participation is voluntary.

            During each successive sick leave cycle of 36 (thirty-six) months employment with the employer, the employee shall be entitled to 30 (thirty) working days paid sick leave.

            During the first 6 (six) months of employment, the employee shall be entitled to 1 (one) working day sick leave in respect of each 26 (twenty-six) days worked.
