    Due leave and company's obligations to permit it

    Does a company have any obligation to grant permission to take leave if an employee applies?

    When I was single and married without children I was required to take leave outside of school holidays so that parents with children could take up the holiday periods.
    There was also a 'leave roster' so that not too many people were off at the same time.
    There were other busy times like stock taking where no leave was allowed.
    Other than that if you give enough notice they should not be allowed to refuse you.

      My 2 cents. A lot will depend on the contract for instance all construction/builders have to take their holiday over the Christmas period. But I think for most other industries you can deny leave over certain times - although I would tell the staff member why you cannot give it too them. I make it quite clear that no staff can take leave 2 weeks before christmas - I'm in retail.

        The company has operational requirement considerations. however leave must be taken within 6 months of becoming due at the end of 12 month cycle.
        it is important if they are denying leave to have a record therof so should you leave the employ it is not forfeited because it was not taken within the time limits.
