Hi,
An employee has asked for Special Sport Leave as he has been chosen to represent the province in a provincial sport fixture. Is there such a thing as Special Leave for sport? Appreciate any feedback.
There is only compassionate leave.
I think it will be up to the employer to decide whether to grant the employee time off or whether he/she has to apply for leave.
Considerations may be the frequency of this happening and the impact it may have on other staff.
Consider that the business may also gain some promotional value by promoting and being associated with the provincial sports star.
Special Leave for Sport is not a statutory leave within the Labour Relations Act or Basic Conditions of Employment Act.
If there is no history of the company having granted it, and it does not form part of the employment contract, there is no entitlement (i.e. you are not obliged to grant it).
This does not mean Special Sport Leave doesn't exist. I am aware that some companies would target sports stars for employment as it would be good PR, and it was normal in these situations for the employment contract to incorporate a Special Sports Leave clause. In essence it is entirely contractual and a "negotiated benefit".
If there is no history, be careful about setting a precedent...
