Question Can someone get the medical aid tax credit if he is not the main member?

    Hello,
I would like to know: Husband is employed at company X and has asked them to take into account the medical aid tax credit on his payslip for the medical aid of which he is a beneficiary, but not the main member. His wife is the main member, it is a recognised medical aid, and the contribution are paid over from his own bank account monthly.

If you answer - please refer me to the part in the income tax act or similar proof that this will be allowed/dissallowed by SARS.

    Thanks!

Only the person in who's name the medical aid is, can claim the deduction. So only the wife would be able to make the deduction for both on her income tax.

    Section 18 (1)

Notwithstanding the provisions of section 23, there mustl be allowed to be deducted from the income of any taxpayer who is a natural person an allowance in respect of-- a) any contributions made by that taxpayer in respect of the year of assessment in respect of that taxpayer, his or her spouse and any dependant, as defined in section 1 of the Medical Schemes Act, 1998 (Act N0. 131 of 1998), of that taxpayer to-

    i) any medical scheme registered under the provisions of that Act, or

ii) any fund which is registered under any similar provision contained in the laws of any other country where the medical scheme is registered,
